Terms of service

These terms govern your use of PatientOS, provided by JSA Healthcare Pty Ltd (trading as PocketDoc).

1. Acceptance

By accessing or using PatientOS (the “Service”), you agree to these terms. If you're agreeing on behalf of a clinic or organisation, you confirm you're authorised to bind it. If you don't agree, don't use the Service.

2. The Service

PatientOS is a practice management platform for Australian clinics, operated by JSA Healthcare Pty Ltd (ABN 79 140 499 976). We may add, change or remove features as the Service evolves.

3. Beta

The Service is currently provided as a beta. It is made available on an “as is” and “as available” basis, may contain defects, and may change or be interrupted. Don't rely on the beta as the sole record of any critical information, and keep your own backups of essential data.

4. Accounts and access

You're responsible for your account, for keeping your credentials secure, and for activity under your account. Access to create a clinic is granted by us during the beta. You must provide accurate information and keep it up to date.

5. Acceptable use

  • Use the Service only for lawful purposes and in line with these terms.
  • Don't attempt to disrupt, reverse engineer, or gain unauthorised access to the Service or other clinics' data.
  • Don't upload unlawful content or anything that infringes another's rights.

6. Your data and privacy

As between you and us, a clinic retains ownership of the data it enters. We handle personal information in accordance with our privacy policy. The clinic is responsible for having the right to collect and use the patient information it enters, and for obtaining any necessary patient consents.

7. Availability

We aim to keep the Service available and reliable but, during the beta, we don't offer a formal service level or uptime guarantee, and we may perform maintenance from time to time.

8. Fees

Any fees (and free beta access) will be communicated to you. We'll give reasonable notice before introducing or changing charges that apply to you.

9. Intellectual property

We and our licensors own the Service and all related intellectual property. These terms don't transfer any of our intellectual property to you beyond the right to use the Service as permitted here.

10. Limitation of liability

Nothing in these terms excludes rights you have under the Australian Consumer Law that can't lawfully be excluded. Subject to that, to the maximum extent permitted by law, we aren't liable for indirect or consequential loss, and our total liability arising from the Service is limited to the amount you paid us for the Service in the 12 months before the claim (or, during a free beta, to AUD $100).

11. Termination

You may stop using the Service at any time. We may suspend or terminate access if these terms are breached or if we discontinue the beta. On termination, your right to use the Service ends; we'll handle your data in line with our privacy policy.

12. Governing law

These terms are governed by the laws of the Australian Capital Territory, Australia, and you submit to the non-exclusive jurisdiction of its courts.

13. Changes to these terms

We may update these terms from time to time. The “last updated” date above reflects the current version; continued use after a change means you accept the updated terms.
